Yes they will! I am in the same situation and I actually called the IRS 800 number to ask questions. No matter what state you live in, if the non-custodial parent owes back child support, his/her taxes will be withheld and put towards the past due amount. But I also know that some states won't do it if they owe little amounts, but for 2000 they will. My daughter's father owes me over 5000 and the government will withhold taxes for anything over 250. It it taken out of the federal amount not the state, but the government can choose to take the state too if they decide but definitly the federal! Hope this helps!...Also, if he is filing jointly with somebody then the government can hold the money for up to 6 months! It depends on our situation, when you will get it back. by giving him your daughter as a tax dependent you might be losing out on alot of money yourself. If you give it to him, and you still file taxes, you can still get the earned income credit. etc-


and, are you going through the child support office? I would maybe call them and make sure - just so they can double check themselves that they did their job.





btw - if they do take his tax return..it will take months for you to get..it has to go to the child support office- and then I think they have to wait a certain amount of time before it can be sent to you-
They will, and it doesn't take $2000 - they'll withhold it for much less than that.
Yes, the IRS is committed to taking deadbeat parents's refunds and directing them to payment of back child support. You have to file with the state, it doesn't happen automatically, so you have to go to court, get a judgement, go to your state's attorney. Different states have different procedures for collection of back child support. The government feels a parent's obligation to support their kids is paramount.

at that amount yes. anything under that amount usually depends on whether the agency has reported the back support debt.if your return is higher than 2000, then the IRS will deposit the remaining portion like usual, just later than expected.
i think they will as long as they are aware of it. and i think they can only hold the state tax returns if i'm not mistaken
oh yes they sure will...well in NC at least i know for sure...last year my BD was behind for me and his other child and they took all that he owed out of his check and he ended up with nothing left!!

Yes they will, which is why most men that owes child support doesn't really file. My uncle was in this situation just two weeks ago.

Yes, if there is a court ordered child support order. As soon as you are at least $500.00 behind they will offset your state and federal taxes. The IRS will intercept whatever amount the child support office asked for, and then send him back the rest. Then they will hold it for at least 3 months in case there is a dispute or injured spouse claim. Then the IRS will release it to the child support agency, and child support will apply it to his account and send it to you. As far as whether or not he should claim the child, it all depends on your divorce decree if you have one yet. Most parents alternate years. So if you let him have 2007, make sure you get the even years if you don't already have a final divorce.
