They need to file a petition for child support modification. My finace just filed one actually in November. Now he is going to mediation and if they don't come to an agreement in mediation which is next week then there is a hearing set for next month. And no he will not get reimbursed. You should talk to an attorney because it's not just about having one kid live with the other parent. They look at both incomes and the amount of time each kid spends with each parent. Some attorneys don't charge for a first time consultation.

That is an issue for the court to decide.





You need to talk to the clerk and go back to court and let the judge decide and make a court order adjusting the support and giving him custody of said child. Until then do nothing. But save your money in the even you do have to repay.





PS- If a man can pay child support on his kids so can a woman. The judge is likely to tell you to get a job so you should start looking for one now.





And if you get a job prior to court the judge may consider child care costs when calculating the new child support amount.





And to be honest, you can do this on your own by asking the clerk for the forms you need. But, reality is, you have a better shot with an attorney arguing the case on your behalf. Especially one well versed in family law.
