In New York State an absent parent (the parent who does not live with the child) is legally obligated to pay support on each child until the child reaches the age of 21. The absent parent will be charged 17% of their wages for support for one child. The percentage goes up with each additional child.
In order to get out of paying support :
1) The absent parent must apply to family court to have the child emancipated. This means proving the child has moved out of his custodial parent's home and is self sufficient.
2) The absent parent must prove, in court, that the child has married or entered the military.
3) The absent parent must prove, in court, that the child is deceased.
4) If the absent parent is deceased then someone, on their behalf, must prove this to the court.
It all depends on what state you live in as each state has different laws regarding child support.
OK...since you went into more detail about your question...NO, you cannot be held responsible for support for your grandchild. You didn't have sex...you didn't hold a gun to his head and make him have sex. The only way you would be responsible is if you went to court and got custody. Can a parent be held responsible for their child's support payment if the child is 17 years old?
Depends on the state that you are in and the legal age. For most states, yes you will be held responsible for non-payment of child support.
EDIT: Thanks fo the thumb down you jack asses. Oh and to the poster, you should have posted the full question that it is your son in question and not you. Please make sure in the future with any question asked that you give full details. Can a parent be held responsible for their child's support payment if the child is 17 years old?
You're probably still responsible for your son's upkeep until he's 18 or whatever the support decree states, but NOT for HIS kids. He is legally responsible for any kids that he fathered (and there is no cop-out for being a minor--I read where a judge ordered a 13 year old to get a paper route and start making payments for the baby he fathered).
I don't think so, since the child is not yours. I'm not sure though, and laws on the subject of child support vary by state.
The best thing to do would be to google child support laws for your state, or contact a lawyer.
Best of luck to your family. And good for you for making your son step up! So many fathers of young fathers don't...
yes, deadbeat. a parent is responsible for child support payments until the child is at LEAST 18, then usually a lot of states have laws pending on if the child is still in school/college. a good parent should WANT to help the child out anyway, not just because it's the law.
If the parents separated prior to the child's 17th birthday, they can be held responsible for ';back payments';. I know a man whose ex-girlfriend found him recently - the child is now in college, but he has to pay back-support for those 17 years.
*hint word* child.
if they're not 18, they're still considered a child. Meaning ..
ding ding ding, thats right.
Child Support payments.
Question, whyy haven't they been making regular payments before? Or if they have, why'd they stop?
hope this helps.
Yes. Generally you're responsible until they're 18. In some states you're responsible until they're 21 (and even if married in some cases).
What would be so horrible about helping to support your minor child? I dont understand parents who make babies and expect the other parent to support them completely. Deadbeat!!!
YES! You must pay child support as long as it says in your agreement... The general payments end at the age of 18, but some people have them put in until the children are out of college...
Yes... You could have to pay some support while they go to college too. You should check your local child support laws.
Yes. The child support order has to be fulfilled.
Yes deadbeat.
yes. if he's 18 %26amp; over then no.
