I want to know if there is something in the statutory rape law about a parent giving consent to both parties?

If before anything ever took place a parent or step parent gave consent (state is mo) is there still room for prosecution? all parties were aware and there was consent from an adult that was legal and a guardian. Can they possibly convict if three parties all had consented?I want to know if there is something in the statutory rape law about a parent giving consent to both parties?
Yes, there is---and in all likelihood will it come to this: the rapist will be convicted of statuatory rape because he had sex with a minor(under the age of 16)but the guardians who gave consent to this will face criminal charges for child abuse and lose custody of that child. If the person in question has not gotten charged yet, it will be best to end the sexual relationship and immediately seek counsel of an attorney with the minor person to get all this on record for future protection against lawsuits. If the person in question cares about the minor then this person can absolutely wait until the minor is of legal age, right?


It is such, that the decision to have sex was not made by the guardians--they committed abuse by consenting to have their minor child involved in sex. The person who decided to have sex with a minor was fully aware of the statute(law), yet, decided to have sex anyway, and it does not matter on consent of guardians, it only matters how old the second party was and if under the age of sixteen it is statuatory rapeI want to know if there is something in the statutory rape law about a parent giving consent to both parties?
There isn't a provision of parental consent in the Statutory Rape clause.





I would actually be careful with giving parental consent for this charge as the parent may be prosecuted as an accomplice to the charge. The child who is under the age of consent wouldn't be charged with anything, it would be the adults (over 18) who either commited the sexual acts, and the parents who approved of the act.
not only would there be a statutory rape charge against the adult sex partner but the parent who consented would also be brought up on charges, which depending on the prosecutor could be as high as conspiracy to commit rape





rape, including statutory rape, is not a crime against the victim...it is a crime against society, which is why the victim cannot consent and neither can the victim's parent
Yep the person still can and will be convicted of statutory rape, sentence as a sex offender and will have to register the rest of their life as a sex offender where ever they would go





no the parents cannot not give consent for the minor to have sex, and if they would try that route they could be convicted of endangering welfare of the child,

i dont like the whole deal because the younger party doesnt get in trouble do they? for all we know it was theyre idea sheeeshh.
They can convict the consenting/knowledgeable adults, too!

Knowledge of the crime being committed makes them guilty, too!
Ok, sex with a minor is illegal, even if everyone consented, so yes, all three can be prosecuted.
